Which Surrogate’s Court the estate is in

The house is sold in the county where it sits. That county’s Surrogate’s Court issues Letters Testamentary or Letters of Administration. We work estate files in these courts:

You do not have to live here. Out-of-state administrators are welcome in every county above. We handle the local side: the house, the title work, and the closing. Your estate attorney handles the court.

Letters Testamentary and Letters of Administration

You cannot transfer the deed until the court has given you authority:

  • Letters Testamentary — you are the executor named in the will.
  • Letters of Administration — there is no will, and the court appointed you administrator.

You can start with us before those letters issue. We can walk the property, pull comps, and put both numbers in writing so you and the heirs can decide. We close when you have authority — not before.

If the will or the court requires confirmation of the sale, we work with your counsel on that step. We do not ask you to skip the court.

What we take on

  • As-is. Occupied, vacant, deferred maintenance, personal property still in the house. You do not have to clean it out or fix it to get a number.
  • No fees or commissions on a cash sale. We pay standard closing costs on that path. If you list, listing compensation is disclosed up front like any other agency listing.
  • Your timeline. Some estates need to close as soon as letters issue. Some need sixty or ninety days. You set the date we can actually close.
  • Liens and judgments. Mortgages, taxes, and judgments are paid through the title company at closing, with counsel. We do not pretend those disappear. We work them.
  • Out-of-state administrators. Video walkthrough if you cannot fly in. Documents go through your attorney and the title company.

Frequently asked questions

Can I sell the house before probate is finished in New York?

You can start the sale before probate is fully wrapped up. You generally cannot transfer title until you have Letters Testamentary or Letters of Administration (and, in some files, court confirmation). We can evaluate the house and hold a number while the estate is still in Surrogate’s Court, then close when you have authority.

Do all the heirs have to agree to sell?

The executor or administrator is the one with authority to sell, subject to the will and the court. In practice, heirs who are entitled to notice should be kept in the loop, and a disagreement can slow the file. If the estate needs to sell to pay debts or carrying costs, counsel can ask the court. We do not referee family disputes. We give you both numbers so the conversation has facts.

I live out of state. Can I still sell a New York probate house?

Yes. Out-of-state administrators are a normal part of this work, whether the house is in White Plains, Brooklyn, Mineola, Goshen, or another county we work. We handle the local property side. Your estate attorney handles the court. Closing is a New York attorney closing; you do not have to be in the room if your counsel sets it up that way.

What if I do not have Letters Testamentary or Letters of Administration yet?

Call anyway. We can start — walkthrough, comps, both numbers — before letters issue. We close when you have authority. That way the estate is not starting from zero the week the clerk hands you the letters.

What are the carrying costs while the house sits?

Property taxes, insurance, utilities, lawn or snow, and the risk of a vacant house. In Westchester and Nassau those tax bills are not small. Every month the estate is open, those costs come out of what the heirs will net. That is why some administrators take the cash number, and some list. The right answer is the one that matches the file.

Are there fees or commissions?

What if the house has liens, judgments, or is in rough condition?

We buy as-is. Mortgages, taxes, and judgments are typically paid through title at closing, with counsel. Condition — including a house that is still full — does not block a cash number. We do not need it show-ready.

How is this different from a regular cash buyer or a regular agent?

A cash-only buyer can only give you one number. A listing-only agent can only list. Steve does both, under CrossWest Home Buyers, so an administrator can see cash as-is and a listing path on the same file. That is the point of this page.
